Applicability

These Terms of Sale (“Terms of Sale”) apply to all purchases of products through American Century Brands, Inc.’s affiliated brand Fruiter (“Company,” “we,” “us,” or “our”) and its website located at www.eatfruiter.com (the “Website”). These Terms of Sale are incorporated into and subject to the Company’s Website Terms of Use, found at https://eatfruiter.com/pages/terms-of-use (the “Terms of Use”). In the event of conflict, these Terms of Sale control for product purchases and the Terms of Use control for all other matters. Capitalized terms not defined herein have the meanings given in the Terms of Use.

By placing an order through the Website, you agree to be bound by these Terms of Sale. If you do not agree to these Terms of Sale, you must not make any purchases through the Website.

Eligibility

All purchases are subject to the eligibility requirements set forth in the Terms of Use. You must be at least 18 years of age and reside in the United States or any of its territories or possessions to make a purchase through the Website.

Orders and Acceptance

Your placement of an order constitutes an offer to purchase the identified products, subject to acceptance by the Company. We may refuse, cancel, or limit any order in our sole discretion and without liability, including for: (a) product unavailability; (b) pricing or product information errors; (c) concerns about order accuracy or legitimacy; (d) suspected commercial resale in violation of the Terms of Use; or (e) any other reason. An order is not accepted until we send an order confirmation email, and we may cancel any order prior to shipment. If we cancel after payment has been processed, we will issue a full refund to your original payment method.

We may limit quantities available for purchase, impose per-order quantity limits, and discontinue any product at any time without notice.

Customer-initiated cancellation requests received within 15 minutes of order placement during business hours will be accommodated on a best-efforts basis, but are not guaranteed once the order has entered fulfillment.

Pricing and Payment

All prices are in U.S. dollars, exclusive of applicable taxes and shipping, which are calculated at checkout. If a product is listed at an incorrect price due to typographical or supplier error, we may refuse or cancel any order at that price regardless of confirmation or payment status. If payment has been charged for a cancelled order, we will issue a full refund.

Payment is due at the time of purchase via a payment method accepted by the Website. You represent that you are authorized to use the payment method provided and that all information supplied is accurate and complete. You authorize the Company and its payment processors to charge your payment method for the full order amount, including taxes and shipping. The Company is not responsible for fees charged by your bank or payment provider.

Product Descriptions

Product descriptions, images, ingredients, nutritional data, and allergen information on the Website are subject to the Product Descriptions and Allergen Disclaimer in the Terms of Use. We cannot guarantee that your device display will accurately reflect actual product appearance. Minor variations in color, packaging, or appearance do not constitute a defect or basis for return, refund, or replacement.

Shipping and Delivery

We ship only within the United States and its territories and possessions. Estimated delivery dates are not guaranteed and are for informational purposes only. The Company is not liable for shipping delays caused by carriers, weather, or other events beyond our reasonable control.

Risk of Loss and Title

Title and risk of loss pass to you upon delivery to the shipping carrier. The Company is not liable for loss, damage, or delay after carrier delivery. Your sole remedy for products damaged in transit is as set forth in the Returns and Refunds section below.

Returns and Refunds

Given that our products are food items, we do not accept physical returns. If your product arrives damaged, defective, or incorrect, please contact us within fourteen (14) calendar days of delivery at info@eatfruiter.com. Failure to report an issue within this timeframe may result in the denial of your claim.

Refunds & Replacements

We may, in our sole discretion, offer a refund or replacement in the following cases:

  • Damaged items during shipping

  • Incorrect items received

To request a refund or replacement, please email us at info@eatfruiter.com with:

  • Your order number

  • A brief description of the issue

  • Photos of the damaged or incorrect product and packaging (required for damage claims; failure to provide photographic evidence may result in denial of your claim)

Non-Returnable Items

We will not accept returns or issue refunds for:

  • Opened or used products (unless defective upon receipt)

  • Products that have been improperly stored after delivery (including, without limitation, exposure to heat, humidity, or other conditions inconsistent with product labeling)

  • Products for which a refund or replacement request is submitted more than fourteen (14) calendar days after delivery

  • Orders suspected of being fraudulent or in violation of these Terms of Sale or the Terms of Use

Refund Processing

Approved refunds (approval or denial being at the Company’s sole discretion) will be issued to your original payment method within approximately five (5) to ten (10) business days. Processing times may vary by financial institution, and the Company is not liable for delays attributable to your bank or payment provider.

Shipping Costs

We will cover reasonable shipping costs for replacement or correction of damaged or incorrect items, provided the claim is submitted in accordance with these Terms of Sale. Original shipping fees are non-refundable. If the Company provides a replacement, it will select the shipping method in its sole discretion.

Promotional Codes and Discounts

The Company may from time to time offer promotional codes, discounts, or special offers. Unless otherwise stated, promotional codes: (a) may not be combined with other offers or codes; (b) are limited to one per customer per order; (c) are non-transferable and may not be sold or redistributed; (d) have no cash value; and (e) may be subject to additional terms, expiration dates, or restrictions. The Company may modify, cancel, or refuse to honor any promotional code at any time if we believe it is being used in error, fraudulently, or in violation of these Terms of Sale.

Subscribe-and-Save Program

The Company may offer a subscribe-and-save option (the “Subscription Program”) that allows you to receive recurring, automatic shipments of selected products at a specified frequency (e.g., weekly, bi-weekly, or monthly) with free shipping and, for certain order volumes, a discount as identified by the Company. By enrolling in the Subscription Program, you authorize the Company and its payment processors to charge your designated payment method at the then-current price (including applicable taxes and shipping) for each recurring order on a recurring basis at the selected frequency until you cancel. Subscription pricing, product availability, and discount levels are subject to change at any time in the Company’s sole discretion; provided, that we will notify you of any pricing changes before your next scheduled order is processed.

You may cancel, pause, or modify your subscription (including changing the product selection, quantity, or delivery frequency) by managing your account settings on the Website or by contacting us at info@eatfruiter.com. Cancellations and modifications must be received before the next scheduled order processing date to take effect for that cycle; otherwise, the change will apply to the following cycle. The Company is not obligated to refund any subscription order that has already been processed or shipped at the time of cancellation.

The Company reserves the right, in its sole discretion and upon reasonable notice to you, to: (a) discontinue the Subscription Program or any product available through it at any time; (b) cancel or suspend your subscription if your payment method is declined, expired, or otherwise invalid, or if we are unable to process payment after reasonable attempts; (c) substitute a comparable product of equal or greater value if a subscribed product becomes unavailable, with notice to you before shipment; or (d) terminate your subscription for any violation of these Terms of Sale or the Terms of Use. If the Company discontinues a subscribed product without a suitable substitute, your subscription for that product will be cancelled and no further charges will be made for it.

Products received through the Subscription Program are subject to the same Returns and Refunds, Limited Product Warranty, and Limitation on Liability provisions set forth in these Terms of Sale. Subscription discounts may not be combined with other promotional codes or offers unless expressly stated. Subscription benefits are personal to you and may not be transferred, sold, or shared.

Limited Product Warranty

The Company warrants that, at the time of shipment, products sold through the Website will be substantially as described and fit for human consumption in accordance with applicable law. EXCEPT FOR THIS LIMITED WARRANTY, AND TO THE FULLEST EXTENT PERMITTED BY LAW, ALL PRODUCTS ARE SOLD “AS IS” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT ANY PRODUCT WILL MEET YOUR SPECIFIC DIETARY NEEDS, PREFERENCES, OR EXPECTATIONS. YOUR SOLE REMEDY FOR BREACH OF THIS WARRANTY IS A REFUND OR REPLACEMENT AS SET FORTH ABOVE, AT THE COMPANY’S SOLE DISCRETION.

Limitation on Liability for Product Purchases

The liability limitations and warranty disclaimers in the Terms of Use apply in full to all purchases under these Terms of Sale. Without limiting the foregoing, the Company’s total liability for any claim arising from a product purchased through the Website shall not exceed the purchase price actually paid for the specific product giving rise to the claim, regardless of the form of action.

Governing Terms

These Terms of Sale are governed by the Terms of Use in all respects. The Terms of Use provisions for Governing Law and Jurisdiction, Arbitration, Class Action Waiver, Waiver of Jury Trial, Limitation on Time to File Claims, Indemnification, Notice, Waiver and Severability, Assignment, Third-Party Beneficiaries, and Survival apply with equal force to these Terms of Sale. To the extent not addressed herein, the Terms of Use govern.

Changes to These Terms of Sale

The Company may modify these Terms of Sale at any time. Changes are effective immediately when posted on the Website. Your continued purchase of products after posting of revised Terms of Sale constitutes acceptance of the changes.
